Article 1: Acceptance of Terms
Acceptance of terms of sale is made by the confirmation of the order by the customer. In making the payment, the user indicates that he fully accepts these terms.
Article 2: Realization of sales
Sales are perfect between the parties and the property is acquired to the purchaser upon payment of the article, no matter the delivery date.
Article 3: Disclosure Obligations
Royalcheese satisfied its duty of pre-contractual advice and information such as he results from the article L121-18 of the Code of the consumption and articles to which he sends back.
The essential characteristics of articles are resumed in the detailed description which accompanies the photos of articles.
The respect of the article L121-19 of the Code of the consumption ensues from the confirmation of the order.
Article 4: Client Account
The site is freely accessible without registration, but any command requires the registration of the purchaser.
The registration require necessarily: civility, first name, name, email, a password, telephone and the delivery address.
Article 5: Price and means of payment
Prices include all taxes in France and in the European Union. For all purchases made outside the EU, the French VAT of 20% will be deducted when you select your shipping country. However the buyer will have to pay additional taxes and custom charges upon arrival in their country. Please check with your customs office. Articles are provided at the current price at the time of order. Payment is made by credit card or PayPal.
The possibly applied discount codes do not apply at the delivery costs, with the exception of specific coupons of free delivery. They can not be the object of a refund.
Payment Data are kept neither by Royalcheese nor by the organization responsible for the financial transaction. The receipt of fees of the order is effective upon the shipment of the order when payment is made by credit card. The receipt of fees is immediate for payment by Paypal.
All bank data provided by the customer when the payment of order by credit card are subject to automated processing of data by the banking partner of Royalcheese: Credit Mutuel / CIC payment. This automated processing of data intended to define a level of analysis of transactions and to fight against credit card fraud, usurpation and excessive use of its identity.
Royalcheese and Cubyn are the recipients of the data related to the order. The number of N client card is never transmitted or used but profit an encoding system and secure encryption. The highest safety standards are applied to data storage and all conform to the standard Payment Card Industry Data Security Standard (PCI DSS). The customer may object to the communication of its data, knowing that the non-transmission of these data prevents the execution and analysis of the transaction and will lead Royalcheese to suggest another method of reservation.
The occurrence of unpaid due to fraudulent use of a credit card will cause the registration of coordinates related to the order associated with this unpaid within a payment incident file.
According to information delivered by the command analysis system, Royalcheese may need to contact the buyer to ask him to provide them with additional information. The supply of these pieces is in this case a prerequisite for the validation of the reservation.
In order to fight against fraud credit card, a visual check of means of payment can be realized by the customer service of Royalcheese before shipping products.
Article 6: Price adjustment in sale
If an item was purchased within 7 days of the start of sales or promotion period, Royalcheese will on customer request credited the price difference in the form of a voucher on the customer account. This voucher will be granted provided that the product including the size is still available for sale on the site at the time of the request by the client. This voucher is valid for 12 months after credit approval.
Any purchase of sales item or in reduction will not benefit from this downward adjustment.
Article 7: Prices and delivery times
Royalcheese is contractually bound with the provider Wing. Deliveries are made in France by Colissimo. The customer can track his package with his tracking number received by mail.
Orders are processed within one week of their receptions. Within 7 business days will be needed to deliver the order. The delivery will depend on the availability of products and the bank verification needed for the proper functioning of the process. Royalcheese will not be responsible for additional delays caused by the refusal of a bank authorization. In case of delay, it will do everything possible to contact the customer by phone, letter or email.
When the order is processed and sent, a confirmation email containing a number corresponding to the package will be sent to the customer, this information will also be available on the account. If a package would arrive damaged, the customer must refuse delivery and ask that the parcel be returned to Royalcheese. A new parcel will be sent back as soon as possible. The order may, however, be canceled at the customer's request. No returns will be accepted after signing the receipt of the parcel, which express acceptance of delivery. Responsibility for Royalcheese can not be held liable for late delivery. The overtaking of delivery deadline cannot give rise to damages.
Shipping fees are automatically calculated when the buyer establishes his shopping cart and appear in the final amount at the time he finishes his order. Shipping fees are fixed at 6 € with Relais Pickup, 6 € with Colissimo and 16 € with Chronopost for metropolitan France whatever the number of commanded articles. Shipping fees are free for France from 150 €. The delivery costs for delivery within a European Union member countries are set to 15 €. For other international destinations, fees are between 18 € and 25 € depending on the country of delivery. Shipping fees are free for France for orders over 150€ TTC and for European Union member countries for orders over 250€ TTC.
Article 8: Unavailability of the item ordered
If exceptionally, the commanded article was not available any more, the buyer can either proceed to an exchange, or ask to be paid off immediately and at the latest in seven days of the payment which he paid.
Article 9: Quality of articles
The quantity and quality of the item delivered are those established in the order.
Royalcheese reserves the right to modify the goods to be delivered in the hypothesis described by the paragraph 2 of the article R132-2 of the Code of the consumption, that means when the modifications are bound to the technical evolution and when they generate no price increase or change of the quality of the product, being heard that the consumer is free to mention the characteristics to which he subordinates his engagement.
Items sold by Royalcheese are guaranteed new in accordance with the current law and who have, in any case, subject to prior use.
Article 10: No compliance of the order / item damaged
According to article L121-20-3 of of the Code of the consumption, that Royalcheese, as a professional is automatically responsible by rights towards the consumer for the proper execution resulting from the contract concluded at a distance, that these obligations (bonds) are to execute by the professional who concluded this contract or by other service providers, without prejudice to its right of recourse against them; secondly it can be exempted from all or part of his responsibility by proving that improper exucution of the contract is attributable either to the consumer or to the unforeseeable and insurmountable, a third contract, or to a case of force majeure. In case of anomaly concerning the delivery, that is to say, in case of defective item or no compliant in kind (error of color reference), the Customer must promptly even on the day of delivery, to submit its claims to Royalcheese by email on the following address: shop@royalcheese.com.
Any claim beyond the 3 days of delivery will not be accepted.
The absence of complaints, no expression of reservations by the Customer means that the item delivered is deemed satisfactory and can be the object of no subsequent dispute.
Article 11: Cancellation and right of withdrawal
In the term of the article L 121-20 of the Code of the Consumption such as modified by the prescription n°2001-741 of August 23rd 2001 and of the law n°2014-344 of March 17th 2014, the withdrawal period is of 14 days as from the next day of the reception of the article.
The exercise of this right is made through the dedicated form situated in the section Command of the personal account, or via a request by e-mail sent in shop@royalcheese.com. The exercise of this right leads to the refund of the paid sums, after qualitative and quantitative check of returned articles.
Article 12: Returns
The buyer has a right to return the order within seven working days of receipt of the goods. Beyond the deadline, Royalcheese will be free to refuse the exchange or refund. The buyer has the opportunity to request an exchange or refund of one or more item(s) by including its request in the return form included in the order.
The return of orders can be done in the shop at 113 rue de Turenne 75003 Paris, or by post. The return costs are borne by the customer and are not refundable. A check of 6 € payable to Royalcheese is required to request exchange in order to cover the costs of returning for your item(s). If the requested product in exchange is not available, Royalcheese will destroy the check.
Returned products must be in perfect condition and returned in their original packaging, it is added to a package covering the entire product; they must not bear any traces of use, be accompanied by their accessories. The buyer will return the item accompanied of the original invoice and return form.
Only after checking that these conditions are satisfied that Royalcheese will refund items returned, with the exception of the initial shipping. Otherwise, no refund can not be exigible, the client will retain ownership of the product and the item will be returned to the customer at his expense. The refund is made within 15 days following the return of the package via the payment method used during the order.
If an error occurs in the command from Royalcheese, the buyer will be able to be reimbursed the cost of return, or to request a prepaid voucher Colissimo by contacting Customer Service, or by moving to Shop of Turenne at opening hours.
Article 13 : IT law and freedom
According to the law 78-17 of 6 January 1978 consolidated by Law 2004-801 of 6 August 2004, the buyer has the right to access and correct data concerning them. Through Royalcheese and only if the customer has given its initial agreement at the time of registration, address can be transmitted to third parties partners of Royalcheese. Article 14: Intellectual Property
All the elements published within the site, such as images, texts, comments, illustrations, whether visual or audio, reproduced on www.royalcheese.com are protected by copyright, trademark law, patent law and image rights, and for the world. They are the full ownership of www.royalcheese.com.
In accordance with the Code of Intellectual Property, only use for private use subject to different measures even more restrictive of the code of intellectual property, is permitted. Any other use constitutes infringement and is punishable under the Intellectual Property.
Article 15: Litigation
Any protest that may arise on the execution and interpretation of these terms and conditions shall be brought before the courts of Paris, which shall have sole jurisdiction.
